Date disagreement stalls Tongaat Hulett liquidation case


The application in the Durban High Court for the provisional liquidation of sugar giant Tongaat Hulett has been postponed, after applicants and respondents could not agree on dates for the matter to be heard.

All the legal representatives in the matter, which was heard via a virtual link, eventually agreed on the intervention by KwaZulu-Natal Judge President Thoba Poyo-Dlwati, to decide on the dates for the application to be heard. Tongaat Hulett has been under business rescue since 2022, after suffering a R12-billion loss following accounting failures and alleged fraud. It is now faced with provisional liquidation, after a recent business rescue plan involving the Vision Group failed.
Judge Sanele Hlatshwayo says for this liquidation and counter application they have set down a date to be arranged by the Judge President of the region.
“The cost of the postponement of the hearing are to be reserved. I’ve also indicated in paragraph eight that parties will have to agree on the manner in which the hearing of all the applications is to proceed, wether virtually or in the open court.”
