A legal expert says the Madlanga Commission of Inquiry has the prerogative to subpoena the doctor who allegedly treated North West businessman Brown Mogotsi.
This after Mogotsi failed to appear before the commission on Monday, saying he was ill.
He however submitted a medical certificate later on that day but the Commission’s Chairperson Justice Mbuyiseli Madlanga raised concern about an increase in the number of sick notes they were receiving from witnesses.

Advocate Dikeledi Sinakgomo says the doctor should explain Mogotsi’s medical problem.
“Doctor and patient privacy needs to be protected and its protected by the consent Mr Mogotsi has to give to the doctor to give the commission the details of that , but if he fails or doesn’t want to cooporete or he doesn’t want to give a go ahead to the doctor then the Madlanga Commission can subpoena the doctor to come and explain what was the sickness Mr Mogotsi had.”
