Nalukoola to Appeal Ruling Nullifying Kawempe North Election Victory

Hon. Luyimbazi Elias Nalukoola has filed a notice of appeal challenging a High Court ruling that nullified his election as the Member of Parliament for Kawempe Division North and ordered a fresh vote.
According to a document received by the Court of Appeal Registry on Monday, May 26, Nalukoola, through his legal team at PACE Advocates, signaled his intention to contest the decision delivered by Justice Bernard Namanya of the High Court’s Civil Division. The ruling had set aside Nalukoola’s victory on grounds of voter disenfranchisement and electoral malpractice.
“Take notice that the Appellant, Luyimbazi Elias Nalukoola, is dissatisfied with the judgment of Hon. Justice Bernard Namanya from the High Court of Uganda, Civil Division, on the 26th day of May 2025, [and] intends to appeal to the Court of Appeal of Uganda,” the notice reads.
The High Court found that over 16,000 voters in the constituency were denied the right to vote and that Nalukoola personally campaigned on polling day at designated voting locations, violating provisions of the Parliamentary Elections Act.
As part of the ruling, the court declared the Kawempe North seat vacant and instructed the Electoral Commission to organize a fresh election. Nalukoola’s appeal now pauses that process pending the outcome of proceedings in the Court of Appeal.
The address of service for the appellant includes a consortium of law firms led by Nyanzi, Kiboneka & Mbabazi Advocates and PACE Advocates, with the notice drawn and filed by the latter.
Background
The nullified by-election had been conducted following the earlier court annulment of MP Muhammad Ssegirinya’s 2021 election. The March 2025 rerun, which saw Nalukoola declared the winner, was widely contested by the National Resistance Movement’s candidate, Hon. Nambi Faridah Kigongo, who filed the successful petition.
Political observers now say the battle for Kawempe North has become a legal and electoral flashpoint, highlighting the deepening electoral tensions in Kampala’s urban constituencies. The Court of Appeal is expected to set a hearing date in the coming weeks.

The Regime Divided Us”: Bobi Wine Rallies Northern Uganda NUP Leaders in Gulu

The President of the National Unity Platform, Robert Kyagulanyi, alias Bobi Wine, on Monday met NUP leaders from greater Northern Uganda in Gulu City.
The meeting held at the Okura Hotel in Gulu City brought in NUP leaders across West Nile, Acholi, Lango, and Karamoja.
Speaking to the leaders, Bobi Wine said that the divide between the North and Central Uganda was deliberately created by the sitting government to keep people fighting among themselves.
He appealed to the NUP grassroots leaders in Northern Uganda to remain resilient and focused amidst many threats and intimidation from state officials.
He also appealed to the leaders to educate themselves and research the history and current affairs of Uganda so that they make informed decisions.
NUP Secretary General Lewis Rubongoya said that the youths should get ready to participate in the youth election, which is slated for the 6th of June.
Harriet Ageno, a NUP aspirant for Dokolo Woman MP, said that they have been greatly energized by the coming of NUP President Hon. Kyagulanyi to Northern Uganda, adding that they are ready to participate and campaign for their party in the upcoming general election

Weaponizing the Purse: Uganda’s New Law Puts NUP on the Brink of Financial Collapse

The National Unity Platform (NUP), Uganda’s largest opposition party, faces a major financial setback following the enactment of the Political Parties and Organisations (Amendment) Act, 2025, which was passed by Parliament on Tuesday.
The newly enacted law ties government funding to political parties’ adherence to democratic principles — including tolerance, peaceful co-existence, and active participation in the Inter-Party Organisation for Dialogue (IPOD).
It amends Section 14 of the Political Parties and Organisations Act to restrict funding only to those political parties represented in Parliament and compliant with the new conditions.
The move is widely expected to hit NUP hardest as it has been relying on public funds for mobilisation, party adminstration, recruitment of new members, media campaigns, opening grassroots branches across Uganda and engagement with the diaspora.
The party, which has consistently refused to join IPOD, citing its alignment with the ruling National Resistance Movement (NRM), currently receives over Shs 3.1 billion annually from the government under the public funding scheme for parties with parliamentary representation.
Under the new law, such funding will be withdrawn from any party that does not comply with the prescribed values and membership requirements — a provision analysts say is directly aimed at NUP, which the government has repeatedly accused of promoting violence and militarism, especially among its youth base.
Already four members of NUP including Eddie Mutwe are facing robbery charges at Masaka High Court while others remain in jail over accusations of violence.
The Bill, tabled by MP Faith Nakut, sailed through Parliament amid fierce resistance from opposition MPs and some independents. Lira Municipality MP Jimmy Akena described the law as “diabolical” and “crafted in bad faith” without adequate stakeholder consultation.
MP Jonathan Odur, in a Minority Report, argued that the law is unconstitutional and designed to punish dissenting voices.
“It seeks to weaponize public funding and punish opposition parties that do not conform to the ruling party’s preferred channels of engagement,” Odur said during the heated plenary session.
Mandatory participation in IPOD
Clause 1 of the law makes it mandatory for political parties to be members of and participate in activities of IPOD as a condition for receiving funds and other public resources.
NUP has long rejected IPOD, accusing it of being a platform for regime consolidation rather than genuine dialogue.
The Legal and Parliamentary Affairs Committee, in its report, backed the spirit of the law, arguing that conditioning funding will “promote stability, responsible politics, democratic values, and social cohesion.”
The report stated that linking public resources to party conduct would deter extremism and violent rhetoric, and encourage ethical and inclusive political behavior.
Rights advocates, however, warn that the law sets a dangerous precedent and could be used to systematically suppress opposition parties ahead of the 2026 general elections.
“This law essentially says: toe the government’s line or be starved of resources. It is a powerful tool of political control,” said one legal expert familiar with the matter.
With the Act now in force, the Electoral Commission is expected to review funding eligibility for all political parties in Parliament.
For NUP, the clock is ticking — unless it joins IPOD or successfully challenges the law in court, it risks being financially crippled in the run-up to the next elections.
